Welcome to Sugar Rush Candy Couture. By accessing or using our website (the “Site”) and purchasing our products, you agree to be bound by the following Terms of Service (“Terms”). Please read them carefully before using our services.

Any new features or tools which are added to the current store shall also be subject to the Terms of Service. You can review the most current version of the Terms of Service at any time on this page. We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

1. General

  • Sugar Rush Candy Couture is an online candy store based in Sweden, offering premium European sweets for customers within the EU.

  • By using our Site, you confirm that you are at least 18 years old or have parental/guardian consent to make purchases.

  • We reserve the right to update, modify, or replace any part of these Terms at any time. Updates will be posted on this page.

2. Products & Orders

  • All product descriptions, images, and prices are presented as accurately as possible. However, slight variations in colors, packaging, or appearance may occur.

  • Orders are subject to availability. If a candy type is out of stock, we will automatically substitute it with a similar item of equal or greater value, or a candy type you’ve ordered. We strive to keep substitutions minimal and always aim to provide a suitable replacement.

  • If you purchase a Candy Mix, the variety of sweets in each mix can depend on stock levels and new arrivals. We are always trying to bring you the newest, tastiest sweets! On the odd occasion, mixes may vary slightly due to stock levels and/or new arrivals. Any sweet that is swapped out will be either replaced with more of the other sweets in the mix, or a very similar type of sweet.

  • Please note that no refunds will be issued for missing items if acceptable substitutions are provided. Refunds will only be considered if an entire order is unfulfilled and no suitable substitutes are available.
  • We reserve the right to refuse or cancel any order if fraud or unauthorized activity is suspected.

  • If you need to cancel an order, please email us at the address provided below. Cancellations are only possible if the fulfillment process has not already begun. Since all items are made to order, fulfillment can begin immediately after the order is placed, and once it starts, we are unable to cancel the order. If cancellation is possible, please note that transaction fees may be deducted from the refund.

  • Please note that orders containing gift cards cannot be canceled under any circumstances. 

3. Pricing & Payment

  • All prices are listed in EUR (€) or local currency and include applicable VAT unless stated otherwise.

  • Prices for our products are subject to change without notice.

  • Payments can be made using the methods provided at checkout (e.g., credit/debit card, Klarna, PayPal, etc.).

  • By submitting payment details, you confirm that you are authorized to use the chosen payment method.

4. Shipping & Delivery

  • We currently deliver within the European Union (EU).

  • Delivery times vary depending on your location. Estimated delivery times are provided at checkout but are not guaranteed. 

  • Once an order is shipped, Sugar Rush Candy Couture is not responsible for delays caused by courier services or customs.
  • We are unable to refund shipping costs due to delays, as these are beyond our control. Shipping charges are non-refundable, and the customer is responsible for paying them at all times. We strive to ensure timely delivery, but please understand that delays may occur.

  • While we take great care to protect our products, we cannot be held responsible for damages during transit caused by weather conditions. Please be aware that these circumstances are beyond our control.

5. Returns & Refunds

  • Edible items are all final sale. We cannot accept returns for perishable or bespoke items. This applies to all our products, as they are made to order. If an item is returned to sender or refused for any reason, we cannot accept the items, and they will be discarded due to the nature of the products. We are unable to issue refunds, so please ensure that you accept your parcel upon delivery.
  • We do not accept returns or offer refunds based on personal taste preferences (e.g., disliking a particular sweet). Our items are made to order and tailored specifically to your selection, so refunds cannot be issued due to personal taste.
  • If you receive an incorrect or damaged product, please reach out to our customer service team by sending an email to hello@sugarrush-candy.com within 2 days of receiving your order. Please note that photos of both the original invoice and the issue (eg. showing the contents of the box, the items you received, the condition of the box, the condition of the items, etc.) will be required to proceed. The photos MUST show the item exactly as you received it - if any items have been opened, half eaten etc. we will unfortunately not be able to accept them as reliable evidence of an issue. Claims submitted after 48 hours will not be processed, and we will not be able to issue a refund.
  • For issues regarding damaged items during transit, please note that while we take every precaution to pack our products securely, our items are delicate, and breakage may occur. Unfortunately, we cannot offer refunds for damage that occurs during shipping as the items are meant to be consumed, and we appreciate your understanding in this regard.
  • Refunds will be issued only for orders that are unfulfilled or if acceptable substitutions are not available. If an entire order is unfulfilled, we will issue a full refund. However, if a portion of your order is missing but acceptable substitutions are provided, no refund will be issued.
  • Once a refund has been processed, please allow up to 14 working days for the funds to appear in your account. This timeline depends on your bank, and unfortunately, we cannot expedite the process. 

6. Intellectual Property

  • All content on this Site, including logos, text, product images, and design elements, are the property of Sugar Rush Candy Couture and may not be used, copied, or reproduced without prior written consent.

7. Limitation of Liability

  • Sugar Rush is not liable for any indirect, incidental, or consequential damages arising from the use of our products or website.

  • We do not guarantee that the Site will be uninterrupted, secure, or error-free at all times.

8. Governing Law

  • These Terms are governed by and construed under the laws of Sweden.

  • Any disputes shall be handled by the competent courts of Sweden.
