Welcome to Sugar Rush Candy Couture. The following terms and conditions (“Terms”) apply to all orders placed by the customer (”you”) with Sugar Rush c/o North by Northeast AB, reg. no. 559282-5565 (“Sugar Rush”, “we” or “us”) at any of our websites www.sugarrush-candy.com, sugarrush-candy.de, sugarrush-candy.eu, sugarrush-candy.se or sugarrush-candy.store (the “Site”). By accessing or using the Site and purchasing our products, you agree to be bound by the Terms. Please read them carefully before placing an order or using the Site.

We reserve the right to amend these Terms from time to time without prior notice to you. Every time you order a product from us, the Terms in force at that time will apply to the contract between you and Sugar Rush.

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products to you.

1. General

  • Sugar Rush Candy Couture is an online candy store based in Sweden, offering premium candy for customers within the EU.
  • By using our Site, you confirm that you are at least 18 years old or have parental/guardian consent to make purchases.

2. Products & Orders

  • All product descriptions, images, and prices are presented as accurately as possible. However, slight variations in colors, packaging, or appearance may occur.

·        The inclusion of any products or services on our Site at a particular time does not imply or warrant that these products or services will be available at any time. We reserve the right to discontinue any product, or change our prices for the products, at any time. 

·        Once you have placed your order, you will receive an email confirmation of your order. When the product(s) has been shipped from our warehouse, your order is confirmed, and you will receive a confirmation e-mail with the tracking number. All purchases are subject to availability and if we are unable to fulfill your order, we will let you know at the earliest opportunity. If we have already received payment for such order, we will attempt to refund the applicable amount using the same method used to make the payment.

  • We reserve the right to refuse or cancel any order if fraud or unauthorized activity is suspected.
  • If you need to cancel an order, please email us at the address provided below. Note that if the fulfillment process already has begun, you may be obliged to pay compensation for the cancellation. Since all items are made to order, fulfillment can begin immediately after the order is placed.

3. Customer account

  • If you create a user account when using the Site or purchasing an order you are responsible for all activity occurring under your account. You undertake to ensure that no one, except you, uses the log-in details. You may not disclose your username or password to any person. You shall abide by all applicable laws when using the account and shall not impersonate another user or provide false identity information.
  • You shall notify us, without undue delay after becoming aware of or reasonably suspects, any unauthorized use of any password or account or any other security breach related to the account.

4. Pricing & Payment

  • All prices are listed in EUR (€) or local currency and include applicable VAT unless stated otherwise.
  • Prices for our products are subject to change without notice.
  • Payments can be made using the methods provided at checkout (e.g., credit/debit card, PayPal, etc.).
  • By submitting payment details, you confirm that you are authorized to use the chosen payment method.

5. Shipping & Delivery

  • We currently deliver within the European Union (EU).
  • Delivery times vary depending on your location. Estimated delivery times are provided at checkout but are not guaranteed. 
  • All orders are processed within 1–3 business days (excluding weekends and holidays).
  • Orders are shipped on business days only (Monday-Friday, excluding Swedish federal holidays). If you place your order on a weekend or holiday, the above estimates start from the first business day after your order is placed. 
  • During high-volume periods or promotional sales, processing times may be slightly delayed. We will notify you if there are any major delays.
  • Please note that we may close our online shop during holiday season! We will notify our customers with at least one week’s notice via the Site and/or social media channels. During this time, orders will not be processed. If you place orders during this time, we will notify you with details of when the order can be processed.
  • Depending on your location, we may ship to either your residential address or to a local service point. We do not ship to PO/APO/FPO Boxes or any other box-type addresses. 
  • Please ensure all shipping details are accurate before submitting your order. Sugar Rush is not responsible for orders shipped to incorrect addresses provided by the customer. If the parcel is returned to us due to incorrect shipping details, a re-shipment fee will be required.
  • Please also note that if our courier cannot deliver to your provided address due to you not being present to accept delivery, delivery to a nearby collection point is classed as a 'successful delivery', and we therefore accept no responsibility, and will issue no refunds, should you fail to collect it in the designated time period.

      6. The right of withdrawal

      • Provided that none of the exceptions below are applicable, you are entitled to a 14-day withdrawal period. This means that you may cancel any purchase by notifying us accordingly within 14 days from when you received the product ordered. All products must be returned in the same condition as they were delivered in accordance with the instructions of Sugar Rush.
      • Exceptions to the right of withdrawal:
        • Some of our confectionery products (candy) are sufficiently sealed. If the seal has been broken after delivery, the right of withdrawal does not apply to our confectionery products which are not suitable for return due to health protection or hygiene reasons.
        • The right of withdrawal does not apply to confectionery products which by their nature are liable to deteriorate or expire rapidly, such as our products Candy Mixes, Candy Jar and Pick & Mix.
        • The right of withdrawal does not apply to goods which have been manufactured in accordance with the consumer’s specifications, or which otherwise are clearly personalized, such as personalized gift cards.
      • In order to exercise the right of withdrawal please contact us using the contact details set out in section 11. You may also use the standard form for the right of withdrawal provided by the Swedish Consumer Agency.
      • If you use the right of withdrawal, you will be obligated to pay for the return shipping costs and are responsible for the condition of the product after you have received the product and during the return shipping. The product shall be returned within 14 days from the date when we were notified of the withdrawal. The product shall be sent well packaged, in good condition and in its original box and/or packaging.

      7. Complaints

      • We do not accept returns or offer refunds based on personal taste preferences (e.g., disliking a particular sweet). Our items are made to order and tailored specifically to your selection, so refunds cannot be issued due to personal taste.
      • If you receive an incorrect or damaged product, please reach out to our customer service team by sending an email to hello@sugarrush-candy.com. If the product is defective, you must submit such claim to us within a reasonable time after you should have observed the defect. Please note that photos of both the original invoice and the issue (eg. showing the contents of the box, the items you received, the condition of the box, the condition of the items, etc.) will be required to proceed. The photos MUST show the item exactly as you received it.
      • Refunds will be issued only for orders that are unfulfilled or if acceptable substitutions are not available. If an entire order is unfulfilled, we will issue a full refund. However, if a portion of your order is missing but acceptable substitutions are provided, no refund will be issued.
      • Once a refund has been processed, please allow up to 14 working days for the funds to appear in your account. This timeline depends on your bank, and unfortunately, we cannot expedite the process.

      8. Intellectual Property

      • All intellectual property rights, such as trademarks and copyrights at our Site, remain with Sugar Rush Candy Couture and its licensors, including logos, text, product images, and design elements, and may not be used, copied, or reproduced without prior written consent.

      9. Liability and limitation of liability

      ·        Nothing in these terms and conditions shall exclude or limit our liability with regard to any matter for which it would be unlawful due to mandatory law for us to limit or exclude our liability. 

      ·        Sugar Rush Candy Couture is not liable for any indirect, incidental, or consequential damages arising from the use of our products or the Site or for failure to deliver the goods or to meet any of our other obligations under these Terms where such failure is due to an event that is beyond our reasonable control, which includes but is not limited to fire, flood, storm, riot, pandemic, civil disturbance, war, nuclear accident, terrorist activities, acts of government, restriction, suspension or withdrawal of any licenses or changes in the law or regulations.

      • Our maximum liability to you for any loss or damage arising in connection with your order on our Site shall be limited to the total price of your order.
      • We do not guarantee that the Site will be uninterrupted, secure, or error-free at all times.

      10. Governing Law

      • These Terms are governed by and construed under the laws of Sweden.

      ·        As a consumer, you will benefit from any mandatory provisions of the law of the country in which you are resident. Nothing in these Terms affect your rights as a consumer to rely on such mandatory provisions of local law.

      • Any disputes shall be handled by the competent courts of Sweden.
